who should pay property tax if OC is still with builder?



if a 3 yr old bldg is still under builder’s possession , who has not given OC to the members of society, who should pay the property tax for all these 3 yrs( 2006 to till date ) if he refuse what action we should take?

  1. If the Owner is actually in possession of the house and living in it or has taken delivery, then the owner is supposed to pay property tax.

    In this regard, u cannot sue the builder to pay the property tax, merely because of non-issuance of OC. Moreover, property tax has nothing to do with OC and vice-versa.

  2. You say “members of society”, which means society has been formed. Then how come bldg is still under builder’s possession?
    Secondly OC is not granted by the builder but by the municipality.
    If you are in physical possession of the flat then you have to pay all charges.
    You are not supposed to take possession of a flat unless the municipality has issued an Occupation Certificate to the structure.
