Stamp duty payment date & registratio date can be different for sale of property ?



i bought property in June,2009. will be Long term asset in June ,2012. Today i got one buyer who is paying me my price. if i sell today it will be treated STCG. So can i ask the buyer to pay the stamp duty today and make the entire payment today but get the flat registration done in June. can this deal be treated as LTCG.

  1. In Mumbai, there is a proposal under consideration that you will have to pay stamp duty based on the value prevailing on actual date of registration. It is a risky proposal. Further, when the stamp duty is paid today, this becomes the date of sale. When you register is your choice with attendant penalties. But the deal will be dated today i.e. date on which stamp duty is paid.
