Property (land) registered with two names (father and son), if father expires, whether son is having a complete lien on the property or not. the other family members like brothers and sisters will also have the right on that property?

  1. Irrespctive of the relationship, if one out of the Joint owners die, the dead persons successor shall have the right over his share. Therfore a succession Certificate has to be got from the Local Administration Dept. If there are more than one successors, then the share shall be divided among them. This includes the Widow and the daughters of the deceased person


  2. When held jointly, each owner has a right on the property in proportion, say 50:50.
    That means you have right to only 50% of the property.
    Your father’s right in the other 50% will be passed on to his successors if he died intestate.
