we have a plot measuring 240syds in uttar pradesh(allahabad) in my wife’s name .my wife died in 2007.we have 2 major sons.who will be the legal heir for the property.what is the procedure for transfer?

  1. As you say your wife died. Now you are the immediate legal heir of property in the name of your wife, unless she has made a will which says contrary to this.
    as long as you are alive your sons can not claim a single penny from that plot.

    and UP or AP. law applies same all over India, as far as inheritance is concerned.

    for transferring the property you have to visit the Legal consultant who will make the documents for you. with FEE off course.

    you and your wife are joint owners. that means you and your deceased wife have equal rights.

    your wife’s share will be equally shared by you and your two sons being legal heirs.

    Your right now is 50% + 16.66%
    your first son……………..16.66%
    your second son…………16.66%
