If we have the Service Tax Number is it mandatory to file the Service tax even if income is less in a fin year?



If my company’s annual turnover is less then 10 Lakhs (Exemption limit) do I still need to pay the service tax though I have genuine bills and other things and have been regularly paying service tax till now. I came to know about the Exemption limit recently so thought to check here.

    Yes you must, since you have a tax number, it means you are collecting tax on the govt behalf, so you must declare. If not then you are take away the tax money which is meant for govt. this is embezzlement and chargeable offence.

    Better just declare and pay.


  2. In case you do not have adequate receipts you must surrender your registration no. However in response of your query it is clearified that as per master circular issued by Service Tax Department return is not mandatory to file if there is no receipts or less receipts of taxable service receipts. As on date if your receipts from respectives servies is upto Rs 1000000.00 in a year, you are not required to file your return. On the other side service tax regisration must be hold by those service provider whose receipts are in excess of Rs 900000.00
