before making a will. He has left 4daughters and one son behind. Can this property be dividable in these five children of his. Three of his daughters are not willing to take the property as they are going to let by. Now my question is if the property is done on my grandfather name , then will my mother can the share of the property even if the other 4 childrens dont sign the papers. As the other four are not bothered or they are not willing to handover the property share of my mother.

  1. Tell a lawyer that the four children except your mother wants to be the owner of your grandfather property and ask him to do the legal process. Maybe your mother should also find out why the others do not want their share of the property before talking to the lawyer.

  3. Your Q is not clear. How can a person own a property that is not in his name? How does a dead person register this property now? Who is the original owner from whom your grandfather acquired the property? How can you set the ownership issue right?

    Assuming that your grandfather is owner of the property. According to the Hindu Succession Act, 1956 the property will devolve equally among his Class 1legal heirs .

    4daughters and 1son will get one share each by inheritance. You have to apply for a Succession Certificate to a competent court.

    Heirs who do not wish to have a share will have to Release or Relinquish their share in the others’ favour thru a Release or Relinquish Deed.

    The Succession Certificate & the Relinquish Deeds will make your mother the owner.
