I listed my house with an agent with the understanding that if one of two friends buy my property, she would be compensated at 3% commission. One of my friends has made an offer. When my agent sent me the estimated pay out from the transaction, she put in her commission as 6%. Her explanation is that the original deal was only good until she listed the house in MLS. Is this ethical? Or legal?

  1. Go over your contract and make sure it says 3% AND an MLS listing. She agreed to take 3% for being both the seller’s and buyer’s agent for one of two possible buyers. You procured the buyer, so she is only entitled to 3%.

    Even though I think this is another fake question…..

    The contract isn’t with the agent, it is with the broker. There is no “understanding” it is only what is on the signed contract. If the contract is 6% then that is what it is. It will actually look like something illegal and unethical is going on if the broker does not receive the 6% as stated in the contract.
