I have a house under my and my wife’s name. I am overseas. I have given general power of attorney to my father. Now I want to transfer the property to My mother’s name and my wife’s name. What is the procedure for that? How much fees I have to pay? Can my father sign on behalf of me and my wife? The property is in Gujarat, India.

  1. You and your wife being joint owners, have 50% share each on the property.

    Now you can transfer your share in to your mother’s name by a deed of settlement as it is allowed in blood relations with a minimum cost of transfer. Your father being a power holder from you, he can sign the settlement deed on your behalf.

    In Tamil Nadu, the maximum expenses for settlement deed is INR 12,000/- irrespective of any higher value. For Gujarat, you have check with the local registrar.
