  1. Hi Gary,

By assigning POA your uncle gets sole authority (same as the owner). Ensure that he is a very trusted ally. Property matters get a lot merky at times. Why don’t you come down to India for a month or so, hire an estate agent and get things sorted. Also, if your house is located in a prime city location, you can earn a hefty sum from renting it out, and using the same for vacationing in India, once a year.

But if you don’t frequent the country. Better sell it off to reduce the burden.

  3. Write a Power of Attorney in favour of person whom you choose, in a plain paper and get it attested by an officer not below the rank of Attache in the Indian Embassy there in your area.

Send it to your attorney and he has to get it adjudicated in the local registrar office in India. Then he can act legally to deal with your property.
