  1. The persons name on the trust deed is still the recorded owner until the recording of the gifted deed is transferred to the other persons name.

  2. The question that should be asked is was the gift deed recorded at the county recorder’s office in the county in which the property is located?

    The next question is were you gifted all the property or will the person making the gift still own a portion of the property?

    If the deed is properly recorded at the county court recorder’s office then who ever is on the deed is the current owner or owners.

    To find out about the recorded deed you would have to go to the recorder’s office and look up the information. Most county recorders charge a fee for you to look up the information.

    In some instances you might contact a local title company that might do a courtesy and provide a deed for you.

    Some counties have listed property deeds on the internet for you to access. There might still be a fee for using the county services.

  3. If it is in India, during 1987, there was no need for donee signature required in deed. So the the person who got gift can approach the local body or Tahsildar to get name transfer of the property.
