Is there any restrictions in the companies act or income tax act to start a private company in india by nonresidents indians (nobody is living in india at present)

  1. i guess they can.Tax Liability in India arises only for residents in case of Individual Assessee.
    For Corporates, it depends on where the Controlling Head of the company lies.
    If your business is controlled from India, it is liable for tax in India.
    Similarly any income earned or accrued in India gets liable for Tax in India.

    As such, there should not be any legal issue for non-residents starting a business/ Pvt Company in India.
