Can Individual purchase house and get Home loan on spouse name who is not co-owner?



Can Individual purchase house and get Home loan on spouse name who is not co-owner ? but Individual is co-applicant with spouse for home loan to do mortgage of Property.
Also if it can be done then, will spouse of property owner get Tax rebate under 80 C?

  1. One who is not an owner or co-owner can become co-borrower of loan.

    But one who is not an owner or co-owner (but is a co-borrower) cannot claim tax benefit.

  2. Yes as rightly said by HMT, spouse can become a co-borrower by co-applicant. but tax rebate is not possible without ownership on record.

    Alternatively, 50% of rights over the property can be settled by registered deed of settlement even at a later stage and by showing that proof, Tax rebate can be claimed by spouse. For settlement deed the expenses are very less.
