Meaning she has one flat…she wants both her sons to have share…but doesn’t want to sell off the flat. So can one of the son buy the property at half value. what are the implications from stamp duty and income tax angle??

  1. Stamp duty will be calculated as per Market value of the Property prevailing in t he are as per their records. Besides, the difference in price will be calculated as Gift to her son and he will be taxed for the amount exceeding the Exemption Limit.


  2. It is better, to settle the property by deed of settlement which is at a very minimum stamp duty.

    If sale deed is registered, stamp duty at prevailing rates in your state. In TN it is 8%. Income tax is at regular rates if it is short term, and at concessional rates if it is long time gains.
