can a grandson had any right over the grandfather property or same the person over his father property?



can the property be taken form my grand father because he is in undue influence of remaining son (i.e of my uncle). further my father is no more able to work due to some medical grounds and the same my grandfather is neglecting to provide or divide the same and give the share of rights to my father. so is there any help over this matter. and further my grandfather had received the property from his father.

  1. If your grandfather is of sound mind, there is nothing that can be done as it is still his choice in the matter. IF on the other hand he can no longer handle the dealings on his own there might be some legal action that can be taken, but that depends on who has power of attorney.




  2. As the property which is being possessed by your grand-father was being inherited from his own father.– thus it becomes an “Ancestral Property”– and under Hindu Law you and also your father has complete right to sue your grand-father for your rights and if he refuses than

    you and your father can sue him in court for “Suit for Partition under Hindu Law”.


  3. Yes, it is ancestral property and you all have right to it. Your grandfather can give away only that part of the property which is earned by him.
