Can a builder charge for open car parking space prior to formation of co operative society ?



Builder has displayed a notice saying that entry of cars without allotted car parking slot(covered and open) will be stopped. Slots have been allotted to flat owners who have paid the parking charges.

  1. Yes,the space he can sell,it is his right but only to flat owners not outsiders and he includes this in agreement paper,purchaser becomes a lawful owner of parking space.

In order to derive the prerogative right of the builder the impugned notice which he has displayd has to be construed whether it is in accordance with the term and conditions that are set out in the agreements that have been entered with the flat owners.merely a fixation of notice with the contents should not be persumed it has confered any right upon the builder.
