Any legal decisions on legal validity of Fringe Benefit Tax yet ?



Many cases were filed against imposition of Fringe Benefit Tax before High Courts & Supreme Court. Has any decision been delivered yet , either for or against ? Is’nt this a case of JUSTICE DELAYED – JUSTICE DENIED ?

  1. Who gave you this piece of info? Some Fringe Benefits are exmpt from Tax fully ; others are partially taxed.The I-T Act, 1961 as amended from time to time specifies these.
    There are some cases lying pending the judgment of the Court.But, many have been decided long ago. You can’t expect overnight judgment on pending complicated cases.

    1. I am one of the petitioner in the High Court of Madras. A transfer petition by the Union of India in ‘Transfer Petition(Civil) Nos.827 to 920 of 2008 was pending before the Supreme Court. Even I am in dark about the petition. In a recent order on 11.05.2012, the High Court of Calcutta in WP NO. 871 of 2009 writes ” There is some confusion as to whether any steps have been taken for transfer of this Writ Petition to the Supreme Court. There is no direct order that parties can produce on such aspect of the matter. But the parties say that the question of the validity of the fringe benefit tax is pending before the Supreme Court. The interim order subsisting on this petition will continue. ……”.
      Conclude no pronouncement so far by SC. Rest assured. No demands raised by the Dept for yesteryears.
