We had booked a flat in this new project called "Rising city" in Mumbai. This project is a so called megatownship project which is a JV between Hubtown, Rajesh Lifespaces, Terrafrom realty and Marathon group.

We booked this flat on Diwali with a token amount of five lakhs with service tax and we were told that the CC would be obtained by Dec'12.We were also given a holding receipt and asked to pay the remaining balance booking amount of ~ 26lakhs by 26th Jan.

The CC did not come till Jan 1st week and when we started follwing up we were told that the CC is a govt process and it would take its own time. We started getting jittery and when we started regualrly we were told that we should take a call on continuing with holding the flat or withdrawing with FULL REFUND of the token amount with the service tax provided we inform them before they deposited the cheques for the balance booking amount which we had given to them on Jan 23rd. We chose to withdraw and accordingly informed them on 28th Jan.

They promptly acknowledged the withdrawal with a email, but conveniently omitted any mention of the refund of the 5 lakhs and service tax paid as token.

After a lot of follow up they did send a mail but once again very conveniently did not mentioned the amount. Further they now quote some policy , never told to us earluer according to which they would refund the money only when our surrendered flat is sold to someone else.

This according to us is nothing but a ploy to avoid paying us our token money back. please be careful of these people as they are extremely unethical and nothing but a bunch of cheats

Our anxiety is increasing by the day. We shall be extremely grateful for any suggestions/thoughts on getting this money back.

Hello Vikas,

You've the option of going to consumer court with all your documents to file the complaint against builder. If you don't have much time for all these, you need to seek professional services of some lawyer. But only legal option can save you as of now.
